The N.C. Bar disciplinary committee has reached their decision.

A disciplinary committee said Saturday disgraced prosecutor Mike Nifong would be disbarred for his disastrous prosecution of three Duke University lacrosse players falsely accused of rape—a punishment the veteran prosecutor admitted was appropriate.

The committee, after deliberating for a little more than an hour on Saturday, unanimously agreed with the bar on almost every charge—including the most serious allegations—that Nifong’s actions involved “dishonesty, fraud, deceit and misrepresentation.”

The veteran prosecutor, who had already pledged to resign his position in Durham County, would waive any right to appeal the punishment, said his attorney, David Freedman.

His well deserved woes don’t end with this. The players attorneys have indicated that they will seek contempt charges next week.

Finally Some Justice In Durham?

This has been coming since the beginning:

The North Carolina bar filed ethics charges Thursday against the prosecutor in the Duke lacrosse sexual assault case, accusing him of saying misleading and inflammatory things to the media about the athletes under suspicion.

The punishment for ethics violations can range from admonishment to disbarment. The complaint could also force District Attorney Mike Nifong off the case by creating a conflict of interest.

Among the four rules of professional conduct that Nifong was accused of violating was a prohibition against making comments “that have a substantial likelihood of heightening public condemnation of the accused.”

The depth of the problems with this case are summed up with this:

“I don’t see how any member of the public can have confidence in this case. I think it’s making a mockery of our criminal justice system to permit this guy to keep fumbling along,” Duke University law professor James Coleman, one of Nifong’s leading critics, said before the ethics charges were filed. “It’s either total incompetence or it’s misconduct on a scale that is extraordinary.”

My vote goes to the later.
