What has me confused is from this AP story, <em><a href="http://news.yahoo.com/s/ap/20061219/ap_on_re_us/teaching_evolution" target="_blank">Ga. school district abandons stickers</a></em>.</p>
<p>Here is the core of the case:</p>
<blockquote><p>The school board placed the stickers on the cover of biology books in 2002 after a group of parents complained that evolution was being taught to the exclusion of other theories, including the Biblical story of creation.</p></blockquote>
<p>And this is the text of those stickers:</p>
<blockquote><p>This textbook contains material on evolution. Evolution is a theory, not a fact, regarding the origin of living things. This material should be approached with an open mind, studied carefully and critically considered.</p></blockquote>
<p>Straightforward enough, I would think. Then again I&#8217;m not a federal judge. </p>
<blockquote><p>A federal judge ordered the stickers removed in 2005, saying <strong>they amount to an unconstitutional endorsement of religion</strong>. [my bold]</p></blockquote>
<p>Please, can anyone show me where the text of that sticker endorses religion? I&#8217;m just not seeing it.</p>

<p>Ankle Biting Pundits (Bull Dog Pundit) <em><a href="http://www.anklebitingpundits.com/content/index.php?p=546" target="_blank">Carter Appointed Federal Judge Hands Victory To Al-Queda</a></em> &#8212; &#8220;The first thing that strikes me is that how Judge dismissed the government’s claim that the Plaintiff’s could not prove their conversations were being monitored. She relied on the affidavits of lawyers and a journalist who admitted they had contacts with terrorist organizations and people accused of helping the insurgency in Iraq.  So when faced with admissions of people that they are in contact with alleged terrorist organizations &#8211; the Judge ordered the government to stop listening.&#8221;</p>

<p>U.S. District Judge Anna Diggs Taylor in Detroit became the first judge to strike down the National Security Agency&#8217;s program, which she says violates the rights to free speech and privacy.</p>
<p><strong>The American Civil Liberties Union filed the lawsuit on behalf of journalists, scholars and lawyers who say the program has made it difficult for them to do their jobs.</strong> They believe many of their overseas contacts are likely targets of the program, which involves secretly taping conversations between people in the U.S. and people in other countries. [My Emphasis]</p></blockquote>
<p>Well boo-freakin-hoo. If &#8220;their overseas contacts are likely targets of the program&#8221; then the real question should be why are they dealing with suspected terrorists? The question, of course, is rhetorical.</p>
<p>Expect this to go to extra innings.</p>

The organization has consistently been an adversary of law enforcement. The Union’s perspective is almost entirely focused on the criminal which makes many people conclude that rather being a defender of civil liberties, the ACLU is actually the champion of criminal liberties.&#8221;</p>

Instead we will see more of the same.  It would be nice to see the dems try the case in front of an impartial judge for once, you know, in the interest of &#8216;fairness&#8217; and all.&#8221;</p>

Tomorrow&#8217;s Washington Post confirms the latter, as Arlen Specter told an interviewer that he planned to hold up Hayden&#8217;s confirmation as leverage for a more complete briefing on the NSA surveillance program.&#8221;</p>
