Reaction is begining to appear as this ruling is examined.

Captain’s Quarters (Ed Morrissey) Bush Loses On Hamdan — “SCOTUS seems to argue that we must violate the Geneva Conventions in order to uphold them.”

Outside the Beltway (James Joyner) Supreme Court Rules Against Military Tribunals; Geneva Applies to Al Qaeda (Updated) — “While I agree with the administration (and thus disagree with the Court’s majority here) that the Geneva Conventions are largely inapplicable to non-uniformed fighters like terrorists, the idea that this constitutes a “surrender” is over-the-top.”

GOP Bloggers (Jonathan R.) Supreme Court Signs Treaty With Al Qaeda — “Once again the Supreme Court has usurped the executive and legislative branches, this time effectively signing a treaty with Al Qaeda that grants terrorists Geneva Convention protections and access to the American justice system.”

Right Wing News (John Hawkins) Turning Lemons Into Lemonade On The Court’s Gitmo Decision — “Also, if the reasoning here is supposed to be that Congress hasn’t approved of military tribunals, then let’s put it up for a vote. My suspicion is that most Democrats would favor putting these terrorists through the American court system, which would mean long drawn out trials, the risk of classified intelligence sources being revealed, and lots of acquittals. On the other hand, Republicans would favor military tribunals, which would sidestep all of those problems.”

In The Bullpen (Chad Evans) Supreme Court Rules in Favor of Hamdan — “Nothing, at present, will change. Guantanamo isn’t closing down nor are all the detainees being released. A new law will likely be written and new procedures will be executed.”
